{"id":1512,"date":"2022-01-21T10:44:32","date_gmt":"2022-01-21T09:44:32","guid":{"rendered":"https:\/\/www.ems-help.ch\/docs\/ems-timekeeping\/introduction-important-notes\/break-rules\/"},"modified":"2025-05-06T09:49:32","modified_gmt":"2025-05-06T07:49:32","password":"","slug":"break-rules","status":"publish","type":"docs","link":"https:\/\/www.ems-help.online\/en\/docs\/break-rules\/","title":{"rendered":"Break regulation"},"content":{"rendered":"\n<p>The system supports both the manual setting of breaks based on times (e.g. from 12:00 to 13:00) and the statutory observance of breaks.<\/p>\n\n<h3 class=\"wp-block-heading\">Calculating the break time<\/h3>\n\n<p>The break time is recorded on the basis of the first and last recorded time, minus the recorded hours.<br\/><br\/>For example, an employee records from 8:00 &#8211; 9:30, from 10:00 &#8211; 12:30 and from 13:00 &#8211; 17:00. <br\/><strong>The attendance time from 8:00 &#8211; 17:00 = 9 hours<\/strong><br\/>The recorded hours are now deducted from this.<br\/> 9<strong>hours &#8211; 1.5 hours &#8211; 2.5 hours &#8211; 4 hours = 1 hour break time<\/strong><\/p>\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n<h4 class=\"wp-block-heading\">Recorded break time or break time added by rules<\/h4>\n\n<p>If a time type with the setting &#8220;Break&#8221; exists and this is also recorded or added by a rule, it is added to the calculated break time.<br\/><br\/>If a break time from 15:00 &#8211; 15:15 is added to the above example by a rule.<br\/> 1<strong>hour + 0.25 hours = 1.25 hours break time<\/strong><\/p>\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n<h4 class=\"wp-block-heading\">Automatic break deduction for statutory entitlement<\/h4>\n\n<p>The system can enforce compliance with the statutory breaks. If the legal requirement is not met, the necessary break is automatically added.<\/p>\n\n<p>The examination takes place in two stages. The first stage checks compliance with the minimum break per day.<\/p>\n\n<figure class=\"wp-block-table is-style-stripes\"><table><thead><tr><th>Recorded hours<\/th><th>Calculation<\/th><\/tr><\/thead><tbody><tr><td>&gt; 7 hrs.<\/td><td>= 0.5 &#8211; biggest break of the day<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p>The second stage checks the complete break times per day, graded according to the working time (attendance time).<\/p>\n\n<p>For example, an employee records from 07:30 &#8211; 12:00 and from 12:30 &#8211; 17:15, resulting in a break time of 0.5 hours for a working time of 9.25 hours.<br\/>The system would now increase the break from 0.5 hours to 1 hour.<\/p>\n\n<figure class=\"wp-block-table is-style-stripes\"><table><thead><tr><th>Recorded hours<\/th><th>Calculation<\/th><\/tr><\/thead><tbody><tr><td>&gt; 10 hrs.<\/td><td>= 1 &#8211; Break time<\/td><\/tr><tr><td>&gt; 9.5 hours **<\/td><td>= 1 &#8211; (10 &#8211; recorded hours) &#8211; break time<\/td><\/tr><tr><td>&gt; 7.5 hrs.<\/td><td>= 0.5 &#8211; pause time<\/td><\/tr><tr><td>&gt; 7.25 hours **<\/td><td>= 0.5 &#8211; (7.5 &#8211; recorded hours) &#8211; break time<\/td><\/tr><tr><td>&gt; 5.75 hrs.<\/td><td>= 0.25 &#8211; pause time<\/td><\/tr><tr><td>&gt; 5.5 hours **<\/td><td>= 0.25 &#8211; (5.75 &#8211; recorded hours) &#8211; break time<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p><em>** The system takes into account that the recorded hours are not covered by the entitlement. For example, a break deduction of 1 hour would not be correct for 9.75 hours of working time, as only 8.75 hours were worked after the break deduction, but this in turn would only result in a break deduction of 0.5 hours.
